What is employment mediation?

An employment conflict between employer and employee consumes a lot of time, energy, and money for all parties involved. Employment mediation helps get a stalled situation moving again. Through confidential discussions, guided by our neutral mediator, the parties work together to find a resolution.

How does employment mediation work?

A neutral and independent mediator guides the parties toward an outcome that works for everyone. Mediation is voluntary; it can be terminated at any time by either party or the mediator. The mediator only concludes the mediation after all possibilities for reaching an agreement have been carefully explored and a clear solution has been found for the conflict.

Contact with the case manager: the case manager from Result ADR contacts both the employer and the employee. He or she informs both parties about the process and ensures that you are connected with the mediator.

Preliminary conversations: both parties have the opportunity to hold a confidential conversation with the mediator prior to the mediation. During this conversation, the process and approach can be discussed, among other things.

Online intake (optional): if no preliminary meetings take place, both parties will receive a digital questionnaire. In this, you can indicate which topics you would like to discuss during the mediation. This gives the mediator a clear understanding of the interests and positions of both parties.

Start of the mediation: the mediation begins with a meeting at a location that is comfortable for all involved. First, the mediation agreement is signed, ensuring voluntariness and confidentiality. The neutral mediator facilitates a respectful conversation where both parties listen to each other.

Mediation sessions: during the mediation, we assess the interests of both parties and explore different possible solutions. If necessary, the mediator can also speak with each party separately to achieve a breakthrough. Sometimes one meeting is enough, but in other cases, multiple sessions may be needed.

Documenting the solution: your mediator records the agreements made in a settlement agreement or a document of terms. These could be new work arrangements or the mutual termination of the employment contract. The written agreements are legally binding.

Completion and reporting: the mediator keeps the referrer informed about the process and sends a termination notice to all parties once the mediation is completed. If there is a need for mediation again in the future, a new mediation agreement will be drawn up.
