How does employment mediation work?

A neutral and independent mediator guides the parties toward an outcome that works for everyone. Mediation is voluntary; it can be ended at any time by any party or the mediator. The mediator only concludes the process after carefully exploring all options to reach an agreement and finding a clear resolution for the conflict.

Contact with the case manager:

the case manager from Result ADR contacts both the employer and employee. They inform both parties about the process and ensure that you are connected with the mediator.

Preliminary conversations:

both parties have the opportunity to have a confidential conversation with the mediator before the mediation begins. During this discussion, aspects such as the process and approach can be addressed.

Online intake (optional):

if no preliminary meetings take place, both parties will receive a digital questionnaire. Here, you can indicate which topics you would like to address during the mediation. This helps the mediator gain a clear understanding of the interests and perspectives of both parties

Start of the mediation:

the mediation starts with a meeting at a location that is convenient for all parties involved. The process begins with signing the mediation agreement, which ensures voluntariness and confidentiality. The neutral mediator facilitates a respectful conversation where everyone is heard.

Mediation sessions:

during the mediation, we identify the interests of both parties and explore various potential solutions. If necessary, the mediator may also speak with each party separately to achieve a breakthrough. Sometimes a single session is enough, but multiple meetings may be required.

Documenting the solution:

your mediator documents the agreements in a settlement agreement or a memorandum of understanding. These may include new work arrangements or the mutual termination of the employment contract. The written agreements are legally binding.

Completion and reporting:

the mediator keeps the referring party informed about the process and sends a closure notice to all parties once the mediation is completed. If mediation is required again in the future, a new mediation agreement will be drafted.
